# Belgium Packaging EPR & Authorised Representative 2026 | EPRiBEL, Fost Plus, Valipac & Fees

> Since 12 August 2026, Belgium applies the PPWR producer definition. A foreign company can become the Belgian producer when it supplies directly from abroad to a Belgian end user; a non-Belgian producer without a Belgian establishment must use a Belgian EPR authorised representative. The registration duty exists while EPRiBEL is still completing the producer-register interface.

## Belgium changed the answer in the middle of 2026.

### Foreign seller → Belgian private end user

- Producer: The foreign company can be the Belgian PPWR producer because delivery is direct from abroad to the Belgian end user.
- EPR AR: Belgian EPR authorised representative required where the producer has no Belgian establishment.
- Stream: Usually household; classify actual packaging before routing.
- Next: Producer check → Belgian AR → producer registration → Fost Plus / mixed-stream routing.

### Foreign supplier → Belgian professional end user

- Producer: The foreign supplier can become the Belgian PPWR producer when the Belgian recipient is the end user rather than a reseller.
- EPR AR: Belgian EPR authorised representative required for the foreign producer.
- Stream: Often commercial / industrial and routed through Valipac.
- Next: Confirm end-user status before relying on old Type C logic.

### Foreign supplier → Belgian importer / reseller

- Producer: When a Belgian company opens the domestic supply chain and resells, that Belgian actor can be the producer.
- EPR AR: The foreign supplier does not need a Belgian EPR AR for quantities for which it is not the Belgian producer.
- Stream: Classify household / industrial after identifying the producer.
- Next: Do not appoint an AR before confirming who the producer actually is.

### Belgian-established manufacturer / importer / distributor

- Producer: Determine which Belgian-established entity first makes the relevant packaging available under the PPWR producer definition.
- EPR AR: No foreign-producer EPR AR solely because packaging is placed on the Belgian market.
- Stream: Fost Plus, Valipac or both depending on packaging streams.
- Next: Register and route each stream through the correct EPR structure.

## Foreign producer? Belgium now needs a Belgian EPR representative.

- **Who:** A person or legal entity established in Belgium and mandated to fulfil the foreign producer's Chapter VIII EPR obligations.
- **Registration:** The AR becomes part of the producer-registration relationship and must be registered with EPRiBEL.
- **Scope:** Registration, EPR execution and PRO relationships are recurring obligations, not a one-off filing.
- **Boundary:** EPR AR ≠ PPWR manufacturer AR ≠ PRO ≠ public authority.

## The obligation is live. The Belgian producer-register interface is still being completed.

1. **Identify the producer** — Use the PPWR/EPRiBEL supply-chain and end-user decision tree.
2. **Appoint Belgian AR if foreign** — A producer without a Belgian establishment mandates a Belgian EPR representative.
3. **Split household / industrial** — The same producer may have Fost Plus and Valipac quantities.
4. **Register** — The legal registration duty exists; EPRiBEL's interface remains in preparation.
5. **Connect the PRO route** — Fost Plus handles collective registration for members; industrial packaging follows the current Valipac relationship.
6. **Report annually** — Close the ledger, file declarations and archive evidence.

## Household → Fost Plus. Commercial / industrial → Valipac. One producer can need both.

- **Fost Plus:** Belgium's household-packaging EPR organisation. 2026 contributions use material-specific rates and the annual declaration is filed through MyFost.
- **Valipac:** Belgium's commercial / industrial EPR organisation. 2026 financing contribution depends on recyclability and plastic/non-plastic category.

One producer can have both streams. Do not force all Belgian packaging into one account.

## Household EPR, industrial EPR and litter are separate legal money layers.

- **Fost Plus contribution:** Material-specific €/kg. Minimum €100; €250 minimum for obstructive / household hazardous-waste packaging; €50 direct-debit discount.
- **Valipac contribution:** €20 / €63 / €126 per tonne. Recyclable non-plastic €20/t · recyclable plastic €63/t · non-recyclable €126/t · reusable €0/t. Minimum €50.
- **Belgian litter levy:** Separate 2026 statutory layer. Annual €102m pool for covered single-use packaging. Calculated contribution below €500 is exempt. 50% advance: October 2026; final settlement: April 2027.
- **Producer register:** Duty live · interface in transition. Fost Plus collective producer registration is handled at no additional registration cost while EPRiBEL completes the register.
