## Who is the Hungarian packaging EPR Producer?

Start with the actual commercial chain. PPWR Producer logic and Hungary’s existing first-domestic-placement / e-commerce rules must be reconciled, not treated as alternatives.

### Foreign e-commerce → Hungarian user

A foreign seller places an EPR-covered product in Hungary through an electronic-commerce service.

- The foreign seller can be the Hungarian Producer.
- Section 10(2) of the Hungarian EPR Decree requires the national obligations to be performed through an authorised representative.
- MOHU and authority registration follow after the responsible Producer and representative route are fixed.
- Keep the same legal entity, KF classification and quantities across the recurring file.

### Foreign supplier → Hungarian importer

An independent Hungarian operator imports the packaged goods and first places them on the Hungarian market.

- The Hungarian importer can carry the national Producer position.
- Do not assign the foreign supplier automatically; verify the actual supply chain and first Hungarian placement.
- The representative route is not assumed merely because a foreign supplier exists.
- Document the contractual transfer and importer role.

### Own brand / private label

A company makes packaging or a packaged product available under its own name or trademark.

- PPWR can move the Producer analysis toward the brand owner or economic operator making the product available.
- The physical factory is not automatically the EPR Producer.
- Run the Producer assessment before MOHU onboarding.
- Keep PPWR manufacturer duties separate from EPR Producer duties.

### Marketplace sale

A seller uses an online marketplace to reach Hungarian customers.

- Marketplace use does not itself transfer the Producer role.
- If the foreign seller is the Producer and the route is electronic commerce, the Hungarian representative rule remains relevant.
- Marketplace proof does not replace MOHU, authority or KF reporting obligations.
- Retain platform verification evidence separately.

## Hungary already has an operational national authorised-representative rule for foreign Producers.

Under Section 10 of Government Decree 80/2023, a foreign-established Producer may generally use a qualifying Hungarian representative. Where that foreign Producer places circular products in Hungary through electronic commerce, the decree requires the obligations to be performed through the representative.

- **Foreign non-e-commerce Producer:** May fulfil the decree obligations through the qualifying representative.
- **Foreign e-commerce Producer:** Must fulfil the decree obligations through the representative.
- **Establishment:** Representative is established in Hungary.
- **Tax number:** Representative has a Hungarian tax number.
- **Appointment:** Written authorisation is required.
- **Responsibility:** The representative is responsible for performance of the Producer’s decree obligations.

Keep the Hungarian national meghatalmazott képviselő mechanism distinct from a manufacturer representative or tax representative. PPWR Article 45 must be mapped on top of the national route where applicable. ## Hungary uses two operational onboarding layers: MOHU first, competent waste authority / OKIR second.

MOHU is the concession-system operator, not the government regulator. The live national authority / OKIR and MOHU workflows remain operational after PPWR. We do not silently relabel the current Hungarian EPR infrastructure as the final harmonised PPWR Article 44 register.

## Ordinary packaging follows the central MOHU collective route.

Hungary is not a normal packaging PRO-shopping market. MOHU performs collective EPR fulfilment under the concession architecture; ordinary packaging therefore uses the MOHU route rather than comparing competing collective PRO contracts.

No fake PRO comparison: individual fulfilment exists only for specified non-packaging streams under the Hungarian EPR decree. Ordinary packaging is presented through MOHU.

Hungary has statutory 2026 packaging EPR rates in HUF/kg. MOHU EPR money, Hungarian representation, REpont/DRS, NAV product-charge exposure, refundable deposits, third-party cash and Beyoğlu service revenue remain separate.

## Quarterly KF reporting drives the MOHU invoice.

Maintain source records continuously, file the quarterly KF data to the authority by the 20th day after the quarter, and pay the MOHU invoice within 15 days of receipt. Small-producer invoice exceptions do not change the need to keep the underlying evidence accurate.

### Does a foreign e-commerce Producer need a Hungarian authorised representative?

Yes. The current national EPR decree requires the foreign e-commerce Producer to perform its decree obligations through the qualifying Hungary-established representative.

### Can a foreign non-e-commerce Producer use a Hungarian representative?

Yes. Section 10(1) permits that route where the representative satisfies the Hungarian conditions.

### Is MOHU the Hungarian government regulator?

No. MOHU is the concession-system operator. The competent waste-authority / OKIR layer remains separate.

### Is Hungary a competing-PRO packaging market?

Not for ordinary collective packaging EPR. The standard route is MOHU.

### Are the 2026 packaging rates statutory?

Yes. The 33/2025 (XI.28.) EM Decree publishes material-specific 2026 HUF/kg rates.

### What is the normal reporting cadence?
