Belgium packaging EPR is a routing problem. Producer first. Stream second.
Since 12 August 2026, Belgium applies the PPWR producer definition. A foreign company can become the Belgian producer when it supplies directly from abroad to a Belgian end user; a non-Belgian producer without a Belgian establishment must use a Belgian EPR authorised representative. The registration duty exists while EPRiBEL is still completing the producer-register interface.

01 · Producer
Belgium changed the answer in the middle of 2026.
The old Belgian responsible-company logic is no longer enough. Determine the PPWR producer from where the packaging becomes waste, who opens the Belgian supply chain and whether delivery from abroad goes directly to the end user.

02 · EPR authorised representative
Foreign producer? Belgium now needs a Belgian EPR representative.
The AR is not an address rental. It fulfils the foreign producer's Belgian Chapter VIII EPR obligations and is distinct from a manufacturer representative, PRO or public authority.
A person or legal entity established in Belgium and mandated to fulfil the foreign producer's Chapter VIII EPR obligations.
The AR becomes part of the producer-registration relationship and must be registered with EPRiBEL.
Registration, EPR execution and PRO relationships are recurring obligations, not a one-off filing.
EPR AR ≠ PPWR manufacturer AR ≠ PRO ≠ public authority.
03 · Registration
The obligation is live. The Belgian producer-register interface is still being completed.
EPRiBEL said on 26 August 2026 that the register remains in preparation. Fost Plus already handles collective registration for members at no additional registration cost.
The legal producer-registration duty and the operating EPR relationships remain active while the public interface is completed.

A producer without a Belgian establishment mandates a Belgian EPR representative.
The same producer may have Fost Plus and Valipac quantities.
The legal registration duty exists; EPRiBEL's interface remains in preparation.

04 · Two packaging lanes
Household → Fost Plus. Commercial / industrial → Valipac. One producer can need both.

05 · Money layers
Household EPR, industrial EPR and litter are separate legal money layers.
Do not merge Fost Plus material rates, Valipac financing contributions and the 2026 litter levy into one fictional Belgian tariff.

07 · Reporting calendar
28 February is recurring — but 2026 has extra transition clocks.
Fost Plus and Valipac both use annual declarations. Belgium also has a split responsibility year around 12 August and a 15 September 2026 litter-declaration amendment window.
